2 private beaches at Cap Dagne closed down by authorities on day before the Grand Prix weekend
Friday May 25 th 2018, shortly after nine o'clock, eleven gendarmes supervising about fifteen movers landed on the public beach of La Mala, in Cap-D'ail, to remove the equipment (mattresses, parasols ...) from the two private establishments, Eden and the Reserve. An operation decided by the prefecture of the Alpes-Maritimes, supervised by five agents of the departmental direction of the protection of the populations DDPP and three agents of the DDTM. Fifteen final judgments concerning the occupation of the maritime domain on the eastern part of the Alpes-Maritimes département are pending. Gold Eden and The Reserve lost their title of occupation in 2011, because their contract was not renewed by the State. And since the Beach decree, we can not exploit more than 20% of a natural beach. The State is therefore in the process of initiating criminal proceedings under the Commercial Code for unauthorized sale on public property . This procedure records the equipment used for sale. In a statement, the prefect said that "pending the judgment by the administrative court of high-level traffic tickets issued by the maritime service, the operation was intended to record the offense of unauthorized sale on the public domain, an offense punishable by the penal code and the code of commerce. The state has waited for the launch of the private beach season to intervene in Cap d'Ail. And this on the eve of the weekend of the Monaco Grand Prix which we know that some F1 fans are regulars of La Reserve and Eden. "These are the three strongest days of the year - there is no chance of timing," said Jean Botticini, owner of the Reserve. "The seaside material has been confiscated and is recorded pending the presentation of the offense to the high court," said the prefecture. Sadness, misunderstanding and anger for Jean Botticini, who has been owner of the La Réserve since 1981. " All they say is false, we receive a high traffic fine ticket in 2015. We have asked for a delimitation of the public maritime domain, something that has never been done, this expertise is still in progress ", he recalls. "Since 2011 there is no concession, but the DDTM sends me the note.It is about 50.000 € per season.I have always paid the annual fee of the beach." Friday afternoon 25/05/2018 the public beach of La Mala has recovered the 400m2 of mattresses and umbrellas occupied until then by the Reserve and Eden. And quickly, the tourists were able to unfold their towel on the sand source : https://www.nicematin.com
